Juridisk svenska

Level 6

Recognize legal terminology and older formal constructions, while choosing clear wording suited to the reader.

How It Works

Legal Swedish ('juridisk svenska') is a professional register with specialized vocabulary and established text types. Precision is a goal, not a guarantee supplied by any particular grammatical style. It is a core component of formal written style in Sweden.

Key Characteristics:

  • Precision and Objectivity: Legal terminology can distinguish concepts that everyday wording leaves vague. Not every word has a special definition, however, and technical vocabulary may need explanation for readers. Complexity can obstruct understanding rather than improve precision.
  • Specific Vocabulary: It employs a specialized lexicon. This includes terms with precise legal definitions (e.g., fast egendom - real property, lösöre - tangible movable belongings, such as furniture; not the entire category of movable property) and archaic words that have fallen out of common use but are retained in legal contexts (e.g., enär - because/since, ehuru - although. Vederlägga means to refute or demonstrate that a claim is false; it is not limited to law and is not inherently archaic).
  • Sentence Structure: Sentences are often long and structurally complex, containing multiple subordinate clauses. Conditions and exceptions may require complex structure, but a long sentence is not obligatory. Dividing information into clear sentences can preserve the legal distinctions.
  • Passive Voice: The s-passive (e.g., domen avkunnas - the verdict is pronounced) and bli-passive are used extensively. This can focus attention on the action or event. It does not establish objectivity, and an active clause is often clearer when the responsible person or institution matters.
  • Nominal Style: Traditional legal prose often contains many nouns derived from verbs, a feature known as nominal style. For example, ansökan om tillstånd (application for permission) names a process or document, while att ansöka om tillstånd (to apply for permission) describes an action. They are not interchangeable in every sentence, and the noun phrase is not universally preferred or shorter.

In recent decades, there has been a movement in Sweden called klarspråk (plain language) to make legal and administrative Swedish more accessible to the general public, but the core features of traditional legal language remain prevalent in many official documents.

Register Contrast
Han vill inte ha huset längre, så han stämmer den som sålde det. / Käranden yrkar på hävning av köpet av fastigheten.
Both wordings can be grammatical. The legal version names different or more specific concepts; it is not simply a more correct substitute for the everyday sentence. Choose the content and register that the situation requires.

Register Contrast
I enlighet med vår överenskommelse, anhåller jag härmed om att du inhandlar mjölk. / Kan du köpa mjölk som vi kom överens om?
Both wordings can be grammatical. The legal version names different or more specific concepts; it is not simply a more correct substitute for the everyday sentence. Choose the content and register that the situation requires.

Examples (4)

  1. Domen skall avkunnas senast två veckor efter det att huvudförhandlingen avslutats.

The verdict shall be pronounced no later than two weeks after the main hearing has concluded.

Word by Word: The verdict shall be-pronounced latest two weeks after that that the-main-hearing has-been-concluded.

An illustration of traditional formal wording: skall and ska are variants, while avkunnas and avslutats are passive forms. The supine avslutats has an omitted perfect auxiliary in the subordinate clause. This constructed example does not establish a general deadline for judgments.

  2. Överklagande av beslutet ska ske skriftligen inom tre veckor från delgivningen.

An appeal of the decision must be made in writing within three weeks of the notification.

Word by Word: Appeal of the-decision shall happen in-writing within three weeks from the-service-of-process.

Överklagande and delgivningen are nouns derived from verbs. Delgivning is formal service/notification; the applicable appeal period depends on the relevant procedure, not on this grammar example.

  3. Enär svaranden inte har inkommit med svaromål inom föreskriven tid, meddelas härmed tredskodom i enlighet med kärandens yrkande.

Since the defendant has not submitted a statement of defence within the prescribed time, a default judgment is hereby issued in accordance with the plaintiff’s claim.

Word by Word: Since the defendant not has submitted a statement of defence within prescribed time, is issued hereby default judgment in accordance with the plaintiff’s claim.

Enär is old-fashioned “because/since”, not contrastive “whereas”. Svarande, svaromål, and tredskodom are legal terms. The sentence illustrates wording rather than a complete account of when a default judgment can be issued.

  4. Avtal som slutits under tvång må av den tvungne förklaras ogiltigt.

A contract entered into under duress may be declared void by the coerced party.

Word by Word: Contract that has-been-concluded under duress may by the coerced-one be-declared void.

Må is an older formal modal, here translated as “may”. Förklaras is passive, and den tvungne is a noun-like adjective phrase naming the coerced party. This is an illustration of traditional language, not a statement of the conditions or procedure for invalidating a contract.

Common Mistakes

  • Using an active form when the judgment is the thing being announced.

    Domen avkunnar i morgon.
    Domen avkunnas i morgon.

Use passive avkunnas when the judgment is announced. An active alternative names the actor: Domstolen avkunnar domen i morgon. Neither voice guarantees objectivity; the difference is which participant is the subject.
