Legal Register

Level 6

Ngôn ngữ pháp luật (Legal Register) is the specialized style of Vietnamese used in laws, contracts, and administrative documents. It prioritizes absolute precision and binding authority over stylistic elegance.

How It Works

The legal register (ngôn ngữ pháp luật) is a highly specialized subset of the broader administrative style (phong cách ngôn ngữ hành chính - công vụ), essential for anyone dealing with official Vietnamese legal texts.

Key Characteristics:

  • Formulaic Structure (Tính khuôn mẫu): Documents follow a rigid macro-structure, including specific headers like the national motto (Cộng hòa Xã hội chủ nghĩa Việt Nam / Độc lập - Tự do - Hạnh phúc), standardized titles, and a strict layout. This layout and formatting (including font sizes, margins, and capitalization rules) are not just stylistic traditions, but are literally codified and mandated by law. Sentences often utilize core boilerplate vocabulary to frame the document, such as căn cứ (pursuant to), xét thấy (having considered that), theo đó (under which), or nay thông báo (notice is hereby given).
  • Precision and Clarity (Tính minh xác): The language must be absolutely unambiguous. It heavily relies on formal Sino-Vietnamese vocabulary rather than everyday native words (e.g., công dân instead of người dân). Synonyms for the same concept are strictly avoided. This includes a strict adherence to tính đơn nghĩa (monosemy). When words can be understood in multiple ways, they are explicitly defined to have a single meaning within the document. To enforce this, major legal documents include a dedicated Giải thích từ ngữ (Interpretation of Terms) Article early in the text to define terms and ensure absolute precision. Unlike everyday Vietnamese, legal texts require phép lặp từ vựng (lexical repetition) instead of personal pronouns to prevent any fatal ambiguity regarding antecedents, though demonstrative pronouns are permitted and frequently used. To maintain absolute precision, legal texts strictly ban metaphors, similes, and idioms. Furthermore, there is a legally mandated rule that foreign words can only be used if there is absolutely no Vietnamese equivalent available. If a foreign word must be used, it can be used directly if it is common (e.g., Internet), but must be transliterated into Vietnamese if it is not common (e.g., vắc-xin). Abbreviations are also heavily restricted; they must be explicitly defined at their first appearance, and if a document contains many abbreviations, a dedicated Article must be included to define them. This precision extends strictly to punctuation, where a misplaced comma can change the application of the law. To prevent this, the document is broken down into a rigid structural hierarchy: Phần (Part) -> Chương (Chapter) -> Mục (Section) -> Tiểu mục (Subsection) -> Điều (Article). Within an Article, extremely long and complex sentences are further broken down into Khoản (Clause) -> Điểm (Point).
  • Official/Impersonal Nature (Tính công vụ): The language is emotionally detached, objective, and carries binding state authority, distinguishing it from the literary, journalistic, or everyday conversational registers. This principle dictates the language must be entirely neutral, strictly banning exclamation marks, emotive particles, and subjective first-person framing. Polite terms like Kính gửi or Trân trọng are purely institutional conventions rather than expressions of personal feeling. The language must be uniformly understood across the country, prohibiting regional dialects, slang, and colloquialisms. This impersonal tone is grammatically achieved primarily through dropping the subject in general directives, using formal third-person terms, and heavy nominalization (danh hóa). By turning verbs and clauses into nouns using words like sự, việc, quá trình, or hành vi (e.g., việc thực hiện nghĩa vụ), the text becomes abstract and universally applicable. While traditional drafting prefers the active voice, when passive constructions are used, there is a strict semantic split: được is used exclusively for rights and entitlements (e.g., được bồi thường - to be compensated), while bị is used for punishments and liabilities (e.g., bị phạt tiền - to be fined).

Essential Grammatical Features:

  • Deontic Modality: Legal texts heavily rely on modal verbs to express obligation, permission, and prohibition, such as the 'Big Four' legal modals: phải (must), được (may/be allowed to), không được (not allowed to), and bị (subject to penalties/liabilities).
  • Conditional Structures: Laws are often framed as 'Hypothesis-Disposition' using structures like Trường hợp... thì... (In case... then...) or Người nào... thì bị... (Any person who... shall be...).
  • Micro-formatting as Grammar: Complex lists are separated by semicolons, with và (and) or hoặc (or) placed before the final item to clarify the relationship between the listed elements.

While some learners assume this style is archaic, it is a highly modernized, actively evolving system designed for legal safety and airtight clarity.

Examples (4)

  1. Người sử dụng lao động không được sa thải người lao động vì lý do người lao động kết hôn.

    The employer must not dismiss the employee for the reason that the employee is getting married.

    Word by Word: Person use labor not allowed fire person labor because reason person labor marry.

    Notice the deliberate repetition of "người lao động" (the employee) three times instead of using a pronoun like "họ" (they) to ensure absolute legal clarity.

  2. Bên A có nghĩa vụ thanh toán cho Bên B. Nếu Bên A chậm thanh toán, Bên A phải chịu phạt vi phạm.

    Party A is obligated to pay Party B. If Party A pays late, Party A must bear a penalty for the breach.

    Word by Word: Party A have obligation pay for Party B. If Party A late pay, Party A must bear penalty violate.

    In contracts, entities like "Bên A" (Party A) are repeated constantly. Using synonyms or pronouns would invalidate the precision of the agreement.

  3. Ngôn ngữ sử dụng trong văn bản quy phạm pháp luật phải chính xác, phổ thông, cách diễn đạt phải rõ ràng, dễ hiểu.

    The language used in normative legal documents must be accurate, common, and the expression must be clear and easy to understand.

    Word by Word: Language use in document normative law must accurate, common, way express must clear, easy understand.

  4. Căn cứ Luật Tổ chức Chính phủ ngày 19 tháng 6 năm 2015;

    Pursuant to the Law on Organization of the Government dated June 19, 2015;

    Word by Word: Base on Law Organize Government day 19 month 6 year 2015;

    A standard framing sentence pattern using "căn cứ" (pursuant to), which is ubiquitous in the preamble of administrative and legal documents.

Common Mistakes

  • Using everyday pronouns to refer back to legal entities to make the text "flow better."

    Bên A sẽ giao hàng cho Bên B. Sau đó, họ phải thanh toán trong 5 ngày.
    Bên A sẽ giao hàng cho Bên B. Sau đó, Bên B phải thanh toán trong 5 ngày.

    In legal Vietnamese, using a pronoun like "họ" (they) introduces fatal ambiguity (who pays? Party A or Party B?). You must repeat the exact noun phrase ("Bên B").

  • Using native Vietnamese words or synonyms to vary the vocabulary.

    Người chủ không được đuổi người làm thuê.
    Người sử dụng lao động không được sa thải người lao động.

    Legal texts require formal Sino-Vietnamese terminology (e.g., "người sử dụng lao động" instead of "người chủ"). Synonyms violate the rule of consistent terminology.

Learn This First

To learn the legal register (ngôn ngữ pháp luật), learners must be comfortable with high-level Sino-Vietnamese vocabulary and the formal structures used in written Vietnamese. Unlike everyday speech, legal Vietnamese avoids pronouns in favor of repeating full noun phrases and uses specific Sino-Vietnamese compounds to ensure unambiguous meaning.
