Legal Style
Tööandja on kohustatud tagama ohutu töökeskkonna means the employer is obliged to ensure a safe workplace. Laws state duties, rights and bans in fixed patterns.
How It Works
Legal Estonian is precise and formal. Once you know its patterns, laws become much easier to read.
Duties, rights and bans
- on kohustatud + ma-infinitive (is obliged to): Tööandja on kohustatud tagama ohutu töökeskkonna.
- on õigus + da-infinitive, or a noun in the allative (has the right): Igaühel on õigus elule.
- ei tohi / on keelatud (must not / is prohibited): Meelevaldselt ei tohi kelleltki elu võtta.
- tuleb + da-infinitive (must be done): Taotlus tuleb esitada kirjalikult.
Impersonal verbs. Laws often leave out who acts: Nõuete rikkumise eest karistatakse rahatrahviga. (Violations are punished by a fine.)
Set phrases
- käesolev seadus (this Act): Käesolev seadus reguleerib...
- käesoleva seaduse tähenduses (within the meaning of this Act)
- kui seadusest ei tulene teisiti (unless otherwise provided by law)
- sätestatud (laid down), nimetatud (referred to): käesoleva seaduse §-s 5 nimetatud isik
Present tense for rules. Laws state rules in the present: Kõik on seaduse ees võrdsed.
Outside legal texts, much of this sounds heavy. In ordinary writing say see seadus rather than käesolev seadus, and prefer active verbs.

Common Mistakes
Using the da-infinitive after kohustatud.
Tööandja on kohustatud tagada ohutu töökeskkond.Tööandja on kohustatud tagama ohutu töökeskkonna.olema kohustatud takes the ma-infinitive. The object of tagama is then a total object in the genitive: ohutu töökeskkonna.
Using the ma-infinitive after õigus.
Igaühel on õigus elama.Igaühel on õigus elada.õigus takes the da-infinitive (õigus elada) or a noun in the allative (õigus elule).
